Information on how we protect and handle your data in Assisto.
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and the free movement of such data (General Data Protection Regulation – GDPR) and Organic Law 3/2018 of December 5, on the protection of personal data and guarantee of digital rights (LOPDGD), LAMBDA AUTOMOTIVE S.L. informs users of ASSISTO (hereinafter, the Software) about the processing of personal data that they have voluntarily provided during the registration, access, and use of the service.
1. Identification of the data controller

2. Purpose of data processing
LAMBDA is a company that has developed and markets the applications that make up Assisto, which allow for automated management of assistance services, enabling assistance companies and their providers to communicate with each other through these applications. To proceed with the registration, access, and subsequent use of the Software, the User must voluntarily provide personal data (essentially, identifying and contact details), which will be incorporated into automated systems owned by LAMBDA.
The collection, storage, modification, structuring, and, where appropriate, deletion of the data provided by Users will constitute processing operations carried out by LAMBDA, aimed at ensuring the proper functioning of the Software, maintaining the service provision and/or commercial relationship with the User, and for the management, administration, information, provision, and improvement of the service.
3. Legitimacy
The processing of the User's data is carried out based on the following legal grounds that legitimize it: • The request for information and/or the contracting of the Software services, the terms and conditions of which will be made available to the User in any case, prior to their express acceptance. • The free, specific, informed, and unequivocal consent of the User, providing this privacy policy, which must be accepted through a declaration or a clear affirmative action, such as checking a box provided for that purpose. If the User does not provide LAMBDA with their data, or does so incorrectly or incompletely, it will not be possible to proceed with the use of the Software.
4. Retention of personal data
The personal data provided by the User will be retained in the systems and databases of the Data Processor (LAMBDA), as long as they continue to use the Software, and as long as they do not request its deletion. After the contractual relationship ends, in order to clarify any potential responsibilities arising from the processing, the data will be retained for a minimum period of one year.
5. Recipients
The data will be communicated to the involved parties (assistance companies, towing companies, and insurance companies), which is the essential purpose of using the software. Except for the involved parties, no data will be communicated to any third party outside of LAMBDA, unless there is a legal obligation or, in any case, prior consent from the User.
6. Protection of stored information
LAMBDA adopts the necessary measures to ensure the security, integrity, and confidentiality of the data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of individuals (GDPR) and Organic Law 3/2018 of December 5, on the protection of personal data and guarantee of digital rights (LOPDGD) concerning the processing of personal data and the free movement of such data. While LAMBDA makes backups of the content hosted on its servers, it does not take responsibility for the loss or accidental deletion of data by Users. Similarly, it does not guarantee the complete restoration of data deleted by Users, as the said data may have been deleted and/or modified during the time elapsed since the last backup. The services provided or rendered through the Software, except for specific backup services, do not include the restoration of content preserved in backups made by LAMBDA when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always prior to the user's acceptance. The restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to LAMBDA.
7. Exercise of rights
LAMBDA informs the User that they have the rights of access, rectification, limitation, deletion, opposition, and portability, which they can exercise by sending a request to the email: info@lambdamotive.com and to the address of the Data Protection Officer dpo@lambdamotive.com.
Likewise, the User has the right to revoke the consent initially granted and to file complaints regarding rights with the Spanish Agency for Data Protection (AEPD).
8. Applicable law
This Policy will be governed and interpreted in accordance with Spanish legislation, as will the resolution of any dispute or divergence related to this website. The use of the services of this website implies the express acceptance of Spanish jurisdiction.
